DMCA Takedown Policy

Overview

TunePlot respects the intellectual property rights of others and expects users to do the same. Under the Digital Millennium Copyright Act (“DMCA”), we will promptly respond to notices of alleged infringement that comply with the law and our policy below.

How to File a DMCA Notice

  1. Prepare a written notice including the elements listed in What to Include.
  2. Send it to our designated DMCA Agent (see DMCA Agent).
  3. We will review your notice and, where appropriate, remove or disable access to the material and notify the uploader.

If you are unsure whether the material is infringing, consider seeking legal advice. Misrepresentations in a DMCA notice may expose you to liability.

What to Include in Your Notice

  • Your full legal name, contact email, and phone number.
  • Identification of the copyrighted work claimed to have been infringed (a URL or a detailed description).
  • The exact URL(s) of the allegedly infringing material on our service.
  • A statement of good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.
  • Your physical or electronic signature (typing your full name is acceptable).

Counter-Notification

If you believe material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification that includes:

  • Your name, address, phone, and email.
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access disabled.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  • A statement that you consent to the jurisdiction of the courts in your area and will accept service of process from the person who provided the original notice or their agent.
  • Your physical or electronic signature.

Upon receiving a valid counter-notification, we may restore the material unless the original complainant notifies us within 10 business days that they have filed an action seeking a court order to restrain you from engaging in the infringing activity.

Repeat Infringer Policy

Where appropriate and at our discretion, TunePlot may terminate accounts of users who are determined to be repeat infringers.
